The NHPA will implement an opt-out mechanism, which means that companies will only be able to utilize your data with your express consent. It also requires transparency in the way businesses make use of your personal information and the option to opt-out of sharing your information with a third-party, and penalties for noncompliance. Similar to the GDPR the law also prohibits discrimination against people who have their privacy rights protected. For example businesses should not charge more for ensuring your privacy or offering discounts if they share data with third parties.

Federal laws provide many types of protections for the government, such as:

Freedom of Information Act (FOIA) (44 U.S.C. The Freedom of Information Act (FOIA) gives you the right to access information of federal agencies. The Privacy Act of 1975 (5 U.S.C. 552) ensures your privacy by the creation of guidelines that govern the collection, management and dissemination of personal information by federal agencies.

New York State’s Personal Privacy Protection Law (Public Officers Law Article 6-A, sections 91-99) recognizes the public’s concerns about privacy and limits the government’s collection, use and disclosure of your personal information. It also prohibits the use of “secret files” by state agencies, and prohibits the release of personal information without your consent.

Whistleblowers are essential to keeping our government honest. Federal law protects federal contractors, subcontractors, grantees and subgrantees against retaliation if they report waste, fraud or misuse in federal grants or contracts.
